Notice of application published. The first case management conference was held on 21 May 2003 at which this case was consolidated with Argos Limited v Office of Fair Trading (1014/1/1/03).

A further case management conference was held on 1 and 3 July 2003. On 30 July 2003 the Tribunal stayed the two cases and remitted the OFT decision of 17 February 2003 (upon which both appeals were founded) to the OFT to permit certain witness evidence to be the subject of an OFT administrative procedure.

A further hearing took place on 9 October 2003 at which the Tribunal declined to make an order on the application of Argos to set aside the OFT decision of 17 February 2003. Also at that hearing the Tribunal ordered variations to the timetable for the further OFT administrative procedure referred to above. Further case management conferences took place on 1 December 2003 and on 23 February 2004 after which the Tribunal handed down a judgment on an application by the appellants for the disclosure of documents.

The final hearing relating to the issue of liability took place over 7 days from 10 May 2004 to 21 May 2004. The Tribunal handed down judgment on 14 December 2004 dismissing the appeals on liability. By orders dated 21 December 2004 the Tribunal granted the appellants an extension of time for seeking permission to appeal from that judgment. The hearing of the issues relating to the penalty took place on 27 January 2005 at the conclusion of which the Tribunal reserved judgment. The judgment in relation to the penalty was handed down on 29 April 2005.

In a Judgment handed down on 19 October 2006, the Court of Appeal dismissed appeals by Argos and Littlewoods on liability and penalty.
