Summary of appeal published 28 January 2004. By an order dated 19 February the President granted permission for BT Group plc to intervene in the proceedings. The first case management conference took place on 27 February 2004. A second case management conference took place on 4 June 2004. A third case management
conference took place on 2 August 2004 during which the Tribunal gave a judgment on case management issues.

A fourth case management conference took place on 10 September 2004 and was adjourned until 9 December 2004.

On 29 November 2004 the Tribunal issued a judgment in relation to procedure and binding commitments.

A further case management conference took place on 9 December 2004 at which the Tribunal gave a ruling setting down the final hearing for the first available date in July 2005. A further case management conference took place on 18 March 2005. A case management conference took place in private on 14 June 2005, as a result of which the final hearing, which was due to commence on 4 July 2005, has been postponed to a date to be fixed pending OFCOM taking a new decision.
