Claim for damages under section 47A Competition Act 1998 relating to a proceeding pursuant to Article 81 of the EC Treaty and Article 53 of the EEA Agreement in Case No. COMP/E-1/37.512 Vitamins published in the Official Journal of the European Communities of 10 January 2003, OJ 2003 L6/1. The claimants’ legal advisers are Taylor Vinters of Merlin Place, Milton Road, Cambridge CB4 0DP (Ref: EFVP/JD/EJB).
The first case management conference was held on 26 July 2004. A hearing to consider the Defendants' applications to strike out the Claimants' claims or alternatively to determine whether the Claimants have the right to bring their claims as a preliminary issue was held on 28 October 2004. Further case management conferences took place on 8 December 2004, 17 December 2004, 21 January 2005 and 2 February 2005.

Two interim Judgments were handed down on 17 February 2005. Pursuant to a consent order made on 11 February and following a notification from the Claimants to the Tribunal, the Claimant's action against the First to Fourth Defendants have been dismissed. Further consent orders were subsequently made dismissing proceedings against the Fifth to Tenth Defendants (the "Purchaser" Defendants who had been joined to the proceedings purusuant to the Tribunal's judgment of 28 January 2005 ([2005] CAT 1).
