Albion Water introduced a new appeal against the published decision on 23 July 2004 (see case 1046/2/4/04 Albion Water Limited v Water Services Regulation Authority (formerly the Director General of Water Services)(Dŵr Cymru/Shotton Paper). The proceedings in this case have been stayed pending the outcome of case 1046/2/4/04.

A hearing took place on 24 October 2006 to consider consequential matters in cases 1031, 1034, 1045 and 1046. A further hearing took place on 20 November 2006. On 19 January 2007 the Tribunal made an Order that Case No. 1031/2/4/04 shall not proceed and that there be no order as to costs.
