Summary of appeal published on 4 June 2008. A hearing to consider a preliminary issue took place on 26 June 2008. The Judgment on the preliminary issues was handed down at 1.30pm on Thursday 10 July 2008. On 3 September 2008, the Tribunal refused O2’s and T-Mobile’s requests for permission to appeal against the Judgment on the preliminary issue. On 7 October 2008, the Court of Appeal granted T-Mobile and O2 permission to appeal. On 12 December 2008 the Court of Appeal dismissed the appeals by O2 and T-Mobile. On 12 January 2009, O2 applied for permission to appeal to the House of Lords which was refused on 11 February 2009.
