A case management conference took place on 14 August 2007 when Red Bee Media Limited and British Broadcasting Corporation were granted permission to intervene. At the case management conference, the Tribunal ordered the question of whether the Office of Communications has taken an appealable decision under the Competition Act 1998 should be determined as a preliminary issue.

A hearing to consider the preliminary issue took place on 8 October 2007. A Judgment on the preliminary issue was handed down on Wednesday 31 October 2007. The main hearing took place on 7 and 8 April 2008. Judgment was handed down on 20 May 2008. On 19 June 2008 a request for permission to appeal was lodged by Independent Media Support (“IMS”) Limited against the Tribunal’s judgment of 20 May 2008. Permission was refused by written ruling dated 24 July 2008. A ruling on costs was handed down on 15 October 2008. On 16 October 2008, Sir John Chadwick refused IMS’s application for permission to appeal against a decision of the Tribunal of 20 May 2008 on the papers. On 25 November 2008, Longmore LJ heard and refused a renewed application by IMS for permission to appeal.
