Summary of appeal published 30 April 2008. A case management conference took place on 23 May 2008 when Capital Meters Limited ("CML"), Siemens plc ("Siemens") and Meter Fit (North West) Limited and Meter Fit (North East) Limited (together, "Meter Fit") were granted permission to intervene. A further case management conference took place on 22 September 2008. A ruling on admissibility of evidence and disclosure was handed down on 8 October 2008. A supplementary ruling on admissibility of interveners’ material was handed down on 17 October 2008. The main hearing took place between 15 and 29 January 2009. Judgment was handed down on 29 April 2009. On 30 June 2009 the Tribunal refused National Grid’s request for permission to appeal. On 23 July 2009 the Tribunal handed down a ruling on costs.

On 23 February 2010, the Court of Appeal dismissed an appeal by National Grid against the Tribunal’s decision on abuse. It allowed the appeal against penalty and varied the Tribunal’s decision to the extent of substituting a fine of £15 million for the Tribunal’s figure of £30 million.
